Welcome to www.picsume.ca (the “Site”, or the “Platform”)! Your access to, acquisition and use of the picsume.ca website, applications, widgets, tools for candidates, and any other products, software and services provided by us, PICSUME INC, now existing or later developed, which may be accessed through the picsume.ca candidate user account (collectively, our “services”, “products” or “software”) is governed by these PICSUME.ca terms and conditions (this “Terms”).
This Site is owned and operated by PICSUME Inc. This Site is an online hiring platform. By accessing, using, or interacting with the Platform, you agree that you have read and understood these Terms and agree to comply with and be bound by them at all times.
These Terms apply to and govern the ownership, access, use, sharing and protection of data exchanged between PICSUME.ca and you, the “Candidate User” (collectively, the “Parties”) in Canada. This includes while the Candidate User (the “User”) is using and accessing all the existing Platform Services, Products, and Software as defined hereunder, offered and provided by PICSUME.ca at the moment of your accepting these Terms and creating a Candidate User accounts, as well as to all the later developed PICSUME.ca Services, Products and Software as defined hereunder, offered and provided by the Platform.
Employer users (the “Employer”) are B2B users of the Platform who post jobs on Site and may interact with Users. Employers utilizing the Platform are subject to a separate Employer Terms & Conditions agreement (the “Agreement”) that governs this access, responsibilities, and obligations. This Agreement outlines specific terms related to job postings, candidate interactions, and compliance with employment laws. Employers must review and accept this Agreement before using the Site for hiring purposes. In the event of any conflict between these Terms and the Agreement, the Agreement shall take precedence.
These Terms define our relationship and mutual expectations as you use these Services, Products and Software.
Our Services are owned, operated and provided by PICSUME INC., a for-profit organization, incorporated under the Canada Business Corporations ActI, with a vision to provide digital services enabling their SaaS (Software as a Service) product users to meet their hiring/job seeking needs through data-driven logistical solutions and product analytics (referred to as “Picsume” or Receiving Party”). Reference to “Parties” in this Agreement means both Picsume and the User.
Eligibility
The Platform is not available to individuals below fourteen (14) years of age. By using this Site, users agree that they are over fourteen (14) years old. Those who are between the ages of fourteen (14) and the legal age of consent in their jurisdiction must obtain permission from a parent or legal guardian before signing up for a candidate account. By creating a candidate account, these users confirm that they have received the necessary consent from their parents or legal guardians.
You are required to provide accurate, current, and complete information during account creation, updates and communications on the Site. We do not assume any legal responsibility for false statements about age.
Acceptable Use
The Platform is designed and intended solely to be used for job-seeking purposes. By accessing or using our Platform, you agree to adhere to all applicable laws and regulations and to engage with the Platform in a lawful, ethical, and respectful manner.
Users must not engage in any activity that disrupts or interferes with the proper functioning of the Platform or violates the rights of others. Specifically, you agree not to provide false or misleading information, including misrepresenting your identity, qualifications, work experience, or any other personal or professional details. Any attempt to deceive potential Employers, recruiters, or other users is strictly prohibited. Users must not engage in harassment, mistreatment, threats, or intimidation against any other users, employees, or representatives of the Platform.
Users must not violate intellectual property rights by uploading, sharing, or distributing any content that infringes upon the intellectual property rights of the Platform, its owners, or any third party. Attempting unauthorized access, including hacking, breaching, or gaining unauthorized access to any part of the Platform, such as other users' accounts, data, or restricted areas, is strictly prohibited. Users must not engage in fraudulent or deceptive activities, including but not limited to phishing, impersonation, or submitting false job postings. Posting, sharing, or distributing content that is illegal, obscene, defamatory, discriminatory, hateful, or otherwise inappropriate is also prohibited.
Users must not use the Platform for unauthorized commercial activities, such as promoting, advertising, or soliciting services, businesses, or third-party platforms unrelated to job-seeking and career development. Any activity that could compromise the security, stability, or functionality of the Platform, including introducing malware, spam, or any form of automated access such as bots or scrapers, is strictly prohibited.
If we determine, in our sole discretion, that a user has violated these Acceptable Use terms, we reserve the right to take appropriate action, including but not limited to issuing a warning or request for compliance, temporarily or permanently suspending or terminating the user’s account and access to the Platform, removing any content that violates these terms, reporting violations to relevant authorities when required by law, and pursuing any necessary legal action to protect the integrity of the Platform and its users.
If you become aware of any activity that violates these Acceptable Use terms, please report it to our support team available in our Contact Details below. We take all reports seriously and will investigate any suspected violations promptly. Failure to adhere to these terms may result in loss of access to the Platform and potential legal consequences.
User Contributions
Users may contribute content on our platform, which includes the following:
Photos;
Videos;
Public comments;
Employment and Education History; and
General employment background information.
By posting content publicly on our Site, you affirm that all information provided is accurate, lawful, and relevant to job-seeking. Users are solely responsible for the content that they post and acknowledge that any contributions made are publicly accessible unless otherwise specified.
We reserve the right, at our sole discretion, to review, modify, or remove any content that we determine to be in violation of these Terms and Conditions.
Accounts
When creating an account on our Site, you agree that you are solely responsible for maintaining the security and confidentiality of your account credentials, including your password and any other sensitive information associated with your account. You must ensure that all personal information provided during registration and throughout your use of the Platform is accurate, complete, and up to date. If any of your personal details change, you are responsible for updating your account information accordingly. Unauthorized access to your account, whether by negligence or intentional sharing of credentials, is strictly prohibited, and you assume full liability for any activities conducted under your account.
Picsume reserves the right to suspend, terminate, or restrict access to any user account without prior notice if we determine that a user has violated these Terms. Users may submit a written appeal within ten (10) days of account termination for review to our office which can be contacted through the Contact Details section. Picsume reserves the right to assess the legitimacy of the appeal and determine whether it is valid or not. The decision to uphold, modify, or deny the appeal will be made at the sole discretion of Picsume. We will provide a response to the appeal within fifteen (15) business days from the date the appeal is received. The response will include our final decision regarding the appeal, and the User acknowledges that this decision is final and binding.
Sales of Goods and Services
These Terms and Conditions govern the provision of goods and services available on our Platform. Currently, the goods and services offered include online marketing tools, branding resources, and printable dynamic work profiles (referred to as Picsume(s)). While these goods and services are provided free of charge at this time, we reserve the right to introduce fees in the future. Should any charges be implemented, users will be notified in advance, and continued use of the goods and services will be subject to the updated terms. By accessing or utilizing these offerings, users acknowledge that they are receiving goods and services under the terms outlined herein. We make no guarantees regarding the availability, accuracy, or suitability of these goods and services for any particular purpose, and we reserve the right to modify, discontinue, or update them at our sole discretion.
Services Available on Site
Our Site provides various goods and services, including an online hiring platform, Users can access and apply for jobs directly through the Platform. These goods and services are currently offered free of charge; however, we reserve the right to introduce fees in the future. If any charges are implemented, Users will be notified in advance, and continued use of these offerings will be subject to the updated terms.
These Terms and Conditions apply to all goods and services displayed on our Platform at the time of access, including those listed as unavailable or out of stock. While we strive to provide accurate information, descriptions, and images regarding our goods and services, we do not guarantee their absolute accuracy. Users acknowledge that all purchases or use of goods and services are at their own risk.
We reserve the right to modify, reject, or discontinue any goods or services at our sole discretion and at any time. Where possible, we will provide reasonable notice of such changes, but we are not obligated to do so. If a transaction is canceled after payment has been processed, a full refund will be issued for the amount paid. Users are responsible for monitoring their payment instruments to verify the receipt of any refunds.
Intellectual Property
All content published, displayed, or made available on our Platform, including but not limited to text, images, graphics, logos, icons, audio, video, software, databases, design elements, downloadable files, and overall site composition, is the exclusive property of PICSUME INC and its creators. This also includes proprietary algorithms, source code, trademarks, trade secrets, and any other intellectual property associated with the Platform. Unauthorized reproduction, distribution, modification, or use of any content, whether in whole or in part, without prior written consent, is strictly prohibited. Users are granted a limited, non-exclusive, non-transferable license to access and use the Platform for its intended purposes, subject to compliance with these Terms and Conditions. Any unauthorized use may result in legal action, including but not limited to claims for intellectual property infringement. If you believe that any content on the Platform infringes upon your intellectual property rights, please contact our support team from the Contact Details below with detailed information regarding your claim.
Data
The Parties acknowledge the value of data as a strategic asset and agree to collaborate in a manner that protects their respective interest while enabling data-driven decision-making and innovation. These Terms outlines the rights, responsibilities, and obligations of each party regarding data ownership, usage permissions, data sharing protocols, data security and dispute resolution.
We retain your personal data only for as long as necessary to fulfill the purposes outlined in this policy or as required by law. Once data is no longer needed, we securely delete or anonymize it to ensure that it cannot be reconstructed or used in any way.
We recognize the importance of data ownership and the distinction between Raw Data and Processed Data within our Platform. Users retain full ownership rights over any Raw Data they provide, including but not limited to resumes, employment history, educational background, profile information, and any other personally submitted content.
Once Raw Data undergoes transformation through our Platform—such as data analysis, aggregation, structuring, enrichment, formatting, or integration into our proprietary systems—it becomes Processed Data. Processed Data is the sole property of Picsume and may be used to enhance platform functionality, improve user experience, generate insights, and optimize our services.
Users acknowledge that by submitting Raw Data, they grant Picsume the right to process, modify, and store the data as necessary for the intended functionality of the Platform. However, Picsume will not sell or distribute Raw Data in its original form without user consent. Any aggregated or anonymized insights derived from Processed Data remain the intellectual property of Picsume and may be used for analytical, research, and business development purposes.
If a user deletes their account, Picsume will remove all associated Raw Data, subject to any legal or compliance-related retention requirements. However, Processed Data, which has been anonymized or integrated into broader system analytics, may be retained to support ongoing platform improvements and business operations.
By using our Platform, you acknowledge and agree to these data ownership terms.
The scope of these Terms provides Picsume with access and Permissible Use of Data; it does not establish an agency relationship or independent contractor relationship between User and Picsume.
As a user, you have certain rights regarding your personal data. You may request access to, correction of, or updates to your personal information at any time. If you wish to delete your account and associated data, you can submit a request to our support team.
Additionally, you have the right to withdraw consent for data processing where applicable and opt out of marketing communications. If you believe your rights have been violated, you may lodge a complaint with a data protection authority.

Privacy & Data Protection
We are committed to protecting your privacy and ensuring the security of your personal data. These Terms, in conjunction with our Privacy Policy, outline how the Platform manages data privacy and protection.

Additionally, we may collect employment and educational background details, resume information, and professional qualifications to facilitate job applications and recruitment processes.

Furthermore, we gather usage data, including IP addresses, browser type, device details, and interactions with the Platform. Any communications or support inquiries made through the Platform may also be stored for reference and service improvement.
We implement industry-standard security measures to protect your personal data from unauthorized access, loss, misuse, or alteration. However, while we take every reasonable precaution, no online platform is entirely secure, and we cannot guarantee absolute protection against cyber threats.
AI- Powered Candidate Ranking
Data provided by users may be utilized to objectively assess how well they qualify for a given job position through our Non-Bias AI recommendation engine. This system evaluates key profile data, such as skills, experience, and qualifications, to generate an unbiased ranking that aligns candidates with job opportunities based on objective criteria.
Our AI-driven ranking process is designed to streamline and enhance the hiring process by reducing the time required to match candidates with suitable positions. While we strive to ensure fairness in our AI-powered ranking system, we cannot guarantee the complete absence of bias. We continuously audit and improve our algorithms to align with best practices in ethical AI use. The ranking mechanism operates solely on factual and relevant user-provided data, without consideration of personal attributes unrelated to job performance.
By using our Platform, users acknowledge and consent to their data being processed for the purpose of AI-driven job matching and ranking. This service aims to improve hiring efficiency for both candidates and Employers while maintaining fairness and transparency in the recruitment process.
Free User Accounts
We offer the following free trial of our goods and services: PicsumeTM dynamic work profiles will always be free to all candidate users (the “Users”).
Payments
At this time, Users are not required to make any payments to access the goods and services provided on our Platform. However, should payments be introduced in the future, these terms will govern all transactions made on our Site.

By providing payment information, you authorize us to access and use the designated payment instrument for processing transactions. You also confirm that you have the legal right to use the selected payment method and that all payment details provided are accurate and up to date.
In the event of a transaction, you authorize us to charge the applicable amount to your chosen payment method. If we determine that a payment violates any applicable laws or these Terms and Conditions, we reserve the right to cancel, reverse, or refuse the transaction at our discretion.
If payments become necessary in the future, we will provide advance notice to Users, including details on pricing, billing cycles, and any applicable fees. Users will have the opportunity to review and accept any new payment obligations before being charged.
By continuing to use our Platform, you acknowledge and agree to these payment terms, including any future modifications that may apply.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Consumer Protection Law
Where the Consumer Protection Act, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.
Limitation of Liability
PICSUME Inc., including its directors, officers, agents, employees, subsidiaries, and affiliates, shall not be held liable for any claims, damages, losses, liabilities, costs, or expenses—whether direct, indirect, incidental, consequential, or punitive—arising from or related to your use of the Site. This includes, but is not limited to, any errors, omissions, service interruptions, data loss, unauthorized access, or reliance on any information provided through the Platform.
By using our Site, you acknowledge that you do so at your own risk and agree that PICSUME Inc. is not responsible for any outcomes resulting from the use of our services, including but not limited to employment decisions, hiring outcomes, or job application processes. Furthermore, PICSUME Inc. shall not be responsible for any legal fees or costs incurred as a result of disputes arising from the use of the Site.
PICSUME Inc. provides the Platform and Services on an "AS-IS" and "AS-AVAILABLE" basis. We make no warranties, express or implied, regarding the Platform’s availability, reliability, accuracy, or fitness for any particular purpose.This limitation of liability applies to the fullest extent permitted by law, and in jurisdictions where certain exclusions are not allowed, our liability shall be limited to the minimum extent required by applicable law.
Indemnity
Except where prohibited by law, by using this Site you indemnify and hold harmless PICSUME Inc. and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
Applicable Law
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Ontario, and, where applicable, by the federal laws of Canada.
Any dispute, controversy, or claim arising out of or in connection with these Terms, including questions regarding their validity, interpretation, or breach, shall be resolved through binding arbitration in Ontario, Canada. The arbitration shall be conducted, under the rules of the ADR Institute of Canada (ADRIC) and held in the Province of Ontario. The decision of the arbitrator shall be final and binding on both Parties, and judgment on the award may be entered in any court of competent jurisdiction.
Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.
Changes
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Platform and the way we expect Users to behave on our Site. We will notify Users by email of any changes to these Terms and Conditions or post a notice on our Site.
